This website is operated by Emerson Ag., LLC. Throughout the site, the terms “we”, “us” and “our” refer to Emerson Ag., LLC. Emerson Ag., LLC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on HostGator. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 22 – SALES AND USE TAXES

Emerson Ag & Industrial, LLC. is not required to and does not collect the listed state Sales or Use Tax. Under the listed state law, purchases are not tax-exempt merely because they were made over the internet or because a seller is not required to collect the listed state Sales Tax. The listed state law requires the listed state purchasers to review untaxed purchases and, if any tax is owed, file a the listed state Use Tax Return and pay any tax due.

Core & Warranty Policies

STANDARD WARRANTY

Most products sold by Emerson AG are warranted for a minimum of 12 months.  Our products warranties are regulated by our suppliers and are subject to rules and regulates pertaining to returns and inspections.

An RGA [return goods authorization] form must be requested, any products returned without this form will not be honored.

Any product in question, Emerson Ag must be contacted for analysis before any warranty is given or any replacement parts are sent! Customers requesting warranty service on any product must return the product to teh supplier of choice by Emerson Ag and may be required to provide proof of original purchase. Products failing due to defective parts or workmanship will be repaired, replaced, or credited at Emerson Ag’s discretion. The warranty will be voided if the part has been disassembled, altered, or tampered with in any way! Under no circumstances does this warranty cover any product that, in the opinion of Emerson Ag has been subjected to engine failure, negligent use, misuse, alteration, tampering, improper maintenance, improper application, accident, fire, contamination, or improper installation. High performance applications carry no warranty. However, these may be evaluated on a case by case basis and consideration may be given. Items that will not be allowed for warranty consideration are mileage, transportation charges, food, lodging, equipment down time, equipment rental, loss of profits, communication expense, diagnosis, towing, labor in waiting or overtime, freight/shipping costs, and consequential engine or equipment damage. Legitimate claims, when the product is within the warranty period, will be considered on a case by case basis. All claims for warranty coverage must be filed within 30 days of product failure. Removal and replacement labor may be available at the discretion of the manufacturer on a case by case basis and must be filed at the time of the claim. Certain exclusions may apply.

Q: Is there a cost on returns?

If you are dissatisfied with the product you received or need a different part than what you ordered, you may return your order for a timely refund or exchange. ALL returns will subject to a minimum 25% restocking fee of the invoice total. Additional fees may apply, especially on special ordered items. The products MUST be returned in the same new condition that you received them, uninstalled, and in the original packaging. In order to receive a refund, you MUST return your product in the same new condition in which you received it within 30 days of the purchase date. No refunds will be given on returns after 30 days. The original shipping and handling fees are non-refundable. Exchanges will be permitted ONLY if you call and receive proper authorization first. The customer is responsible for any and all shipping charges associated with returns or exchanges. Please ship your return or exchange to the address provided below using a prepaid, insured, and traceable method of shipping. Call or email for return address.

Q: CORE RETURNS

To be eligible for core credit, the core must be like for like with the item you purchased. Please make sure your core is drained of any fluids, bagged up, and placed back in the original box and packaging. Make sure there is enough packing materials to prevent shipment damage. We do not require a RGA number for return but we do ask that you include a copy of your purchase receipt or at minimum, the name the order was placed under, somewhere on or in the package. Prepaid return labels will be provided for core returns for all continental US addresses; this excludes Alaska and Hawaii. Cores are to be shipped back to us at: Call or email for shop address.

Q: INJECTION PUMPS

Full Core Refund will be given on good cores only when returned within 90 days of the receipt date.

Half Core Refund will be given when:

  • A good core is returned between 3 and 6 months of receipt date
  • Core is or has previously been disassembled
  • Core has a broken/damaged housing or camshaft
  • Core has a seized or cracked head
  • Core is full of rust and/or other contamination
  • Core not like for like will be inspected to establish value 
  • Fire damaged cores will be inspected to establish value
  • Missing parts will be charged against the core
  • NO Core Credit will be given 6 or more months after receipt date

Q: INJECTORS

Full Core Refund will be given on good cores only when returned within 90 days of the receipt date.

Half Core Credit will be given when a good core is returned between 3 and 6 months of receipt date

No Core Credit will be given 6 or more months after receipt date

Any damage that rendering the core unusable will receive no credit.

Cores that are rusted, contaminated, fire damaged, or missing parts, or are not like for like are subjected to a per case evaluation that may result in no credit or partial credit.

Q: TURBO CHARGERS

Full Core Refund will be given on good cores only when returned within 90 days of the receipt date. (must be complete with both housings attached and be like for like)

HALF CORE CREDIT WILL BE GIVEN WHEN:

  • A good core is returned between 3 and 6 months
  • No Core Credit will be given 6 or more months after receipt date

WHERE CORE CHARGE IS $100.00

No Core Credit will be given when core has been removed improperly; such as torching and the core is damaged.

WHERE CORE CHARGE IS $200.00

  • No Core Credit will be given when core has been removed improperly, such as torching and is damaged.
  • Half Core Credit will be given when either housing or wheel is damaged and rendering it unusable

WHERE CORE CHARGE IS $300.00+

  • Full Core Credit will be given when both housings are reusable
  • Half Core Credit will be given when only one housing is reusable
  • NO Core Credit will be given if neither housing is reusable

Q: All Air Conditioning Products

Warranty is regulated by our supplier. All AP Air merchandise is warranted to be free from defective materials and or workmanship for the period specified from the date of purchase. No labor or refrigerant allowance will be allowed for losses involved in the replacement of these parts. During the warranty period, parts determined by AP Air to be covered will be repaired or replaced at AP Air’s discretion. Approved warranties are non-refundable and will be in the form of merchandise credit.
All warranties are to the original owner/purchaser only. A transfer of ownership or any 3rd party installation will termi- nate the warranty. All AP Air parts are to be installed by an authorized dealer or repair technician. A copy of the dated
original installation work order must be furnished with compressor warranty claims. All warranty merchandise must be returned to AP Air for inspection before credit is issued.
This warranty does not cover defects caused by customer neglect, incorrect application, wiring, alteration, or repairs
made outside AP Air’s authorization. This warranty is in lieu of any other warranty, whether expressed or implied.

  • Equipment Tools – 1 Year – Some tools require contacting the manufacturer for repair/warranty.
  • Evaporators – 1 Year
  • Expansion Valves – 1 Year
  • Fan Clutches – 90 Days
  • Fittings A/C – 1 Year
  • Heater Cores – 1 Year

Express Limited Warranty

  • J&N warrants to J&N customers that any good supplied by J&N shall be free from defects in material or workmanship under normal use and service for one year from the date of purchase by a consumer.
  • This express limited warranty does not apply where there has been a failure of goods due to alteration, repairs, misuse, improper installation, neglect or accident.
  • If any part or product sold or distributed by J&N is covered by any manufacturer’s warranty or any other separate or independent warranty supported by the part or products distributor or licensor/licensee, then that warranty shall be the sole and exclusive warranty for the part or product.
  • Warranty claims must be submitted by the J&N customer who purchased the part from J&N.

Optional OEM Warranty

  • If an original equipment manufacturer (OEM) refuses to honor the OEM’s written warranty solely because a J&N replacement part was purchased and used, J&N will allow substitution of the rights and remedies provided under the OEM’s written warranty for the J&N Express Limited Warranty.
  • Written confirmation from the OEM must be provided to J&N stating the OEM has refused to honor the OEM written warranty solely because J&N replacement parts were purchased and used in the OEM product.

Customer Responsibilities and Limitation or Remedies

  • The J&N customer is responsible for any and all transportation costs associated with the examination, inspection, repair or replacement of defective goods under the J&N Express Limited Warranty, Optional OEM Written Warranty and Express Limited Labor Warranty.
  • Damages will not exceed purchase price (not including tax) for what was paid for the goods.

Exclusion of Other Warranties

  • Except as provided above, J&N makes no other express or implied warranties of any kind, including but not limited to Merchantability or Fitness for a particular purpose.
  • Verbal statements about goods by sales personnel/representatives do not constitute warranties and are not part of J&N Warranties.

Exclusion of Incidental and Consequential Damages

  • J&N shall not be liable for any incidental or consequential damages that the consumer alleges that his/her equipment may have suffered as a result of the purchase and/or use of J&N goods.
  • This exclusion of liability for incidental and consequential damages includes, but is not limited to, claims for lost profits, any costs or expenses for labor, transportation or other expenses incurred by reason of the use of sale of any defective goods.
  • Warranties give specific legal rights, and other rights may vary by state, as some states do not allow the exclusion of warranties and incidental or consequential damages, or limitations of remedies.

Product Liability

  • All J&N products are automatically covered by a comprehensive liability policy for both bodily injury and property damage.
